Terms of Service

These terms are the agreement between you and Katsuko Software and Research Labs Private Limited ("obsrvly", "we", "us"), a company incorporated in India, for the use of obsrvly.com and the obsrvly monitoring service. By creating an account or using the service, you accept them. If you accept them for a company or team, you confirm you are allowed to bind it, and "you" means that company or team.

1. The service

obsrvly checks websites, APIs and other systems you choose, from the regions you choose, and alerts you through the channels you set up. The features, limits and prices of each plan are shown in the app before you pay.

We improve the service continually and may change or remove features. If a change materially reduces what a paid plan includes, we will tell you by email at least 30 days before it takes effect. If you do not accept it, you may cancel and we will refund the unused part of your current billing period.

Features marked beta or preview, including AI agent checks, are offered as they are, may change without notice, and are not covered by any refund for downtime.

2. Your account

  • You must be at least 18 years old and give accurate details.
  • Keep your login secure. You are responsible for what happens under your account and your team until you tell us it has been compromised.
  • The team owner controls the team's monitors, data and billing, and can add or remove members.

3. Acceptable use

You may monitor only systems you own or are authorised to monitor. You must not:

  • use obsrvly to load-test, attack, overload or scan systems, or to send traffic to anyone who has not agreed to it;
  • store credentials or secrets for systems you are not authorised to log in to;
  • try to reach our internal systems, get around rate limits or plan limits, or interfere with other customers;
  • use the service for anything unlawful, or to send spam through our alert channels;
  • resell the service without our written agreement.

If we reasonably believe an account breaks these rules, we may pause the monitors involved or suspend the account. Where we can, we will tell you first and give you a chance to fix it. We may act at once to stop harm to others or to our systems.

4. Your data

You own the data you put into obsrvly and the results it produces. You give us permission to store and process that data only to run, secure and support the service for you, as described in the Privacy Policy. We do not sell it, and we do not use it to train AI models.

You are responsible for the content you send through the service, including URLs, headers, request bodies and secrets, and for having the right to send it. Secrets you store are encrypted and are used only by the checks that reference them.

We may use aggregated, anonymised measurements (for example, average response times by region) to run and improve the service. These never identify you or your systems.

5. Fees and payment

  • Paid plans are priced in US dollars and billed monthly in advance through Razorpay. They renew automatically until you cancel.
  • Usage beyond a plan's included browser or AI runs is billed at the overage rate shown on the plan.
  • Prices exclude taxes. Where the law requires it, GST or other taxes are added.
  • We may change prices with at least 30 days' notice by email. A new price applies from your next renewal after the notice period.
  • If a payment fails, your paid features stay on for 7 days while payment is retried. After that, the team moves to the Free plan.
  • When a team moves to a plan with lower limits, by choice or because payment stopped, its oldest monitors that fit the new plan keep running and the rest are paused. Nothing is deleted. Moving back up resumes the paused monitors that fit.

Refunds follow the Refund Policy.

6. Cancellation and termination

You can cancel a paid plan at any time from the billing page. It stays active until the end of the period you have paid for, then the team moves to the Free plan. You can delete your team at any time.

We may end your account if you seriously or repeatedly break these terms. We may also stop offering the service, or end your account for any other reason, with at least 30 days' notice by email; in that case we refund the unused part of any prepaid period.

When an account ends, you have 30 days to export your data, unless it ended for a breach that makes that unsafe. After that we delete it as set out in the Privacy Policy.

7. Availability and alerts

We work to keep obsrvly running and to deliver every alert, but we do not guarantee that the service will be uninterrupted or that every check or alert will run or arrive on time. Alerts depend on third-party services such as email providers, Slack, Microsoft Teams and PagerDuty, which we do not control.

obsrvly is one tool in your operations. Do not rely on it as the only safeguard for systems where a missed alert could cause injury, loss of life or serious damage. No uptime commitment (SLA) applies unless we sign a separate written agreement with you.

8. Warranties

Apart from what these terms expressly say, the service is provided "as is" and "as available". To the extent the law allows, we disclaim all other warranties, including fitness for a particular purpose and merchantability. Nothing in these terms limits rights you have under consumer protection law that cannot be waived.

9. Limitation of liability

To the extent the law allows:

  • Neither of us is liable to the other for indirect or consequential loss, or for loss of profits, revenue, business or goodwill, even if it was foreseeable.
  • Each party's total liability arising from these terms or the service is limited to the greater of (a) the fees you paid us in the 12 months before the event that gave rise to the claim and (b) US$100.
  • These limits do not apply to your obligation to pay fees, to your obligations under section 10, or to liability for fraud, gross negligence, wilful misconduct, or anything the law does not allow us to limit.

10. Your responsibility to us

If a third party makes a claim against us because you monitored a system without authorisation, misused the service under section 3, or sent content you had no right to send, you will cover our reasonable costs and losses from that claim. We will tell you about the claim promptly and let you take part in its defence.

11. Confidentiality

Each of us will keep the other's non-public information confidential and use it only for the purposes of these terms, except where the law requires disclosure. Your monitor configuration, results and secrets are your confidential information.

12. Changes to these terms

We may update these terms. For a material change, we will email the team owner at least 30 days before it takes effect. If you continue to use the service after that date, the new terms apply. If you do not accept them, you may cancel before that date and we will refund the unused part of your current billing period.

13. Law and disputes

These terms are governed by the laws of India. If a dispute arises, please write to us first: we will try in good faith to resolve it within 30 days. If we cannot, the courts of Bengaluru, Karnataka have exclusive jurisdiction.

14. General

  • Neither of us is responsible for delays caused by events beyond reasonable control, such as outages at hosting providers, natural disasters or government action.
  • We may transfer these terms to a company that takes over the service, and will tell you if we do. You may transfer them with our written consent, which we will not refuse unreasonably.
  • If any part of these terms is unenforceable, the rest still applies. Not enforcing a right is not a waiver of it.
  • These terms, the Privacy Policy and the Refund Policy are the whole agreement between us about the service.
  • We send notices to the team owner's email address. Send yours to support@obsrvly.com.
